During the course of the school year, students may be photographed for the purposes of school related publications or area media publications/broadcasts. If you DO NOT want your child’s photograph/likeness and/or name to appear in any District communication (publications, website, and social media), please send a written request to the Superintendent’s Office before the start of school in September. This request must be updated annually. Please note that this opt-out procedure only applies to District publications. The District does not have any control over what is published by the news media or others legally entitled to take photos during events of public interest such as athletic events, etc. where students may be present.

A health exam must be provided to the school within 30 days of the start of the school year and must be completed within 12 months prior to the start of the school year. If you do not provide a health exam, the school will conduct one for your student. NYS Education Law requires health examinations of public-school students who are:

· Entering the school district for the first time, and in grades Pre-K or K, 1st, 3rd,5th, 7th, 9th, 11th, and at any grade level determined by and at the discretion of school administration to promote the educational interests of the student.

· To participate in strenuous activity (athletics).

· Upon student's request for an employment certificate (working papers).

· When conducting an initial evaluation or reevaluation of a student suspected of having a disability or a student with a disability.

Under Public Health Law, students attending school in NYS must receive immunization against poliomyelitis, mumps, measles, diphtheria, rubella, varicella, Haemophilus influenzae type b (Hib), pertussis, tetanus, pneumococcal disease, meningococcal disease, and hepatitis B as appropriate for age and grade. A NYS accepted immunization record must be provided to, and assessed by the school, for the number of age-appropriate vaccine doses and the intervals between doses of vaccine to determine if the student meets the immunization requirements. Students noted to be out of compliance will not be allowed to attend school after 14 calendar days (30 calendar days for out-of-state/country transfers). Proof of a future vaccination appointment is not acceptable in place of the required vaccine. Please contact the School Nurse with immunization questions.

The School District will continue to participate in a student accident insurance plan to assist parents in meeting their responsibilities for payment of health services for accidental injuries sustained by students during supervised, school-sponsored activities.

Parents must notify the school nurse within 30 days following an injury.

The District will then file an injury report with the insurance company and send claim information to the parents, in the event they wish to file a claim.

State law requires a signed written order from a physician and parent/guardian in order for a student to receive any (including over-the-counter) medicine at school. Medication is to be brought to school by the parent/guardian in the original, correctly labeled prescription or product bottle. For specific information regarding these medications on field trips, please contact the school nurse.

The Newark CSD Parent Teacher Associations collaborate with the teachers, administrators, parents, staff and community members of Newark CSD to meet the needs of the youth in our community. Their continued hard work and support has helped create a welcoming environment for the community.  More information will be sent home with your child on how you can become a part of our Elementary PTA Programs.

NYS Education Department and State Law requires an annual physical exam which includes a body mass index and weight status category for those students entering UPK, Kindergarten and grades 1, 3, 5, 7, 9 and 11. Any student entering the school district for the first time is required to have an examination. Participation in a sport requires a health history form and a current physician physical dated within the past 12 months.

The Special Education Department is committed to supporting families and working together to achieve strong outcomes for our students. If your child has a disability or you suspect he/she may have a disability, he or she may be entitled to special education and/or related services without cost to you. A child with a disability is entitled to a Free Appropriate Public Education (FAPE). The Board of Education of the Newark Central School District observes a policy to provide a safe and secure environment to all those persons who lawfully enter upon District property or who travel in District vehicles. The safety and well-being of students, employees and the general public are of prime importance. Pursuant to the New York State Schools Against Violence in Education (SAVE) legislation and Education Commissioner’s Regulation 155.17, school districts are required to develop a districtwide school safety plan designed to prevent or minimize the effects of serious violent incidents and emergencies.

Per NYS guidelines, vision and hearing screenings are required for all new entrants and students in grades Pre-K or K, 1st, 3rd, 5th, 7th, and 11th. If your student is required to have vision and hearing screenings, and the results of these screenings are not provided to the school on your student’s health certificate, the school will conduct the screenings. Per NYS guidelines, if the result of a scoliosis screening is not provided on your student’s health certificate, the school will conduct this screening for girls in grades 5 and 7 and boys in grade 9. Please contact the School Nurse with any questions regarding screenings.

When visiting a school building, all visitors must report to the main office or other secure entrance upon arrival. There, they will be required to show proof of identification which will be used to print a visitor’s identification badge. Badges must be worn at all times in the school or on school grounds. Visitors must return their identification badges to the main office before leaving the building.

The Freedom of Information Law establishes your right to inspect the public records of the Newark Central School District. Requests to inspect school records must be made in writing on a form provided on the District’s website at Freedom of Information | Newark Central School District.  Forms should be submitted to the office of Paul Liess, District’s Records Officer, at 100 East Miller Street, Newark, NY  14513 or paul.liess@newarkcsd.org.

Student records are privileged and confidential. Records are not disclosed to persons other than a student’s parents or guardian, or the student, if over 18 except as expressly required by law. At the time of inspection of student records appropriate school personnel must be present.

Parents or Guardians and eligible students over 18 have a right to:

1. Inspect and review a student’s educational record.
2. Know that the intent of the school district is to limit disclosure of personally identifiable information in those records, except

• by prior written consent of the student’s parents or guardian, or student,
• if over 18.
• disclosure as directory information as defined below
• as otherwise legally allowed for access by school officials

3. Request that records be amended to ensure that they are not inaccurate, misleading or otherwise in violation of a student’s privacy or other rights.
4. File a complaint with the US Department of Education alleging failure of the school district to comply with FERPA rules & regulations.

Requests for access to student records or procedures to be followed for amending student records should be directed to the Office of the Superintendent.

New York State Education Law requires each classroom teacher and school principal to receive an annual professional performance review (APPR) that results in a composite effectiveness score and rating. All parents/guardians have the right to obtain the APPR quality ratings and composite effectiveness scores for their child’s current teacher(s) and principal(s) once they are available. To initiate this request, please contact your child’s principal in their corresponding school.

A plain language version of the Code of Conduct is presented to all students at the beginning of the school year. The behavior and civility requirements of the Code of Conduct apply to visitors and parents/guardians. Notice is hereby given that the annual inspection for the 2025-2026 school year of the school buildings of the Newark Central School District for fire hazards, which might endanger the lives of students, teachers, and employees therein, is current, and the report thereof is available in the Business Office for inspection by all interested persons.

AHERA is the acronym for a federal law that requires all school districts to re-inspect facilities for building materials containing asbestos. District facilities have been inspected and response actions are planned to ensure a continued safe environment for students and employees. Activities include training of maintenance staff to prevent disturbance of asbestos and periodic re-inspection and surveillance activities by trained personnel.

PPRA affords parents and students who are 18 or emancipated minors (“eligible students”) certain rights regarding our conduct of surveys, collection and use of information for marketing purposes, and certain physical exams. These include the right to:

Consent before students are required to submit to a survey that concerns one or more of the following protected areas (“protected information survey”) if the survey is funded, Newark Central School has adopted policies regarding these rights, as well as arrangements to protect student privacy in the administration of protected surveys and the collection, disclosure, or use of personal information for marketing, sales, or other distribution purposes.

Opt-out: Contact the Office of the Superintendent if you do not want your child to participate in any/all of these surveys. The Newark Central School District does not intend to use pesticides; however, New York State Education Law Section 409-H, requires all public and non-public elementary and secondary schools to provide written notification to all persons in parental relation, faculty, and staff regarding the potential use of pesticides periodically throughout the school year. The District is required to maintain a list of persons who wish to receive 48-hour prior written notification of certain pesticide applications. The following pesticide applications are not subject to prior notification requirements:

• a school remains unoccupied for a continuous 72-hours following an application;
• anti-microbial products;
• nonvolatile rodenticides in tamper resistant bait stations in areas inaccessible to children;
• nonvolatile insecticidal baits in tamper resistant bait stations in areas inaccessible to children;
• silica gels and other nonvolatile ready-to-use pastes, foams, or gels in areas inaccessible to children;
• boric acid and disodium octaborate tetrahydrate;
• • the application of EPA designated biopesticides
• the application of EPA designated exempt materials under 40 CFR § 152.25;
• the use of aerosol products with a directed spray in containers of 18 fluid ounces
• or less when used to protect individuals from an imminent threat from stinging
• and biting insects including venomous spiders, bees, wasps, and hornets.

In the event of an emergency application necessary to protect against an imminent threat to human health, a good faith effort will be made to supply written notification to those on the list. Pursuant to federal law, Newark Central School District must disclose to military recruiters and institutions of higher learning upon request the names, addresses and telephone numbers of high school students. Parent(s) may submit a request in writing to the Superintendent of Schools that the student’s name, address and telephone number not be released for this purpose without the prior written consent of the parent(s).

The Newark Central School will release or publish in school newsletters, school or student newspapers, athletic programs, musical or theatrical programs, news releases and the District webpage some and/or all of the following directory information pertaining to students as may be appropriate under the circumstance; name of students, photographs, video, of students, name of parents, grade, age, major fields of study, participation in school activities, extra-curricular activities and sport programs, academic honors, degrees, achievements, awards, scholarships, and height & weight of athletic team members. Under Title 34 C.F.R. Part 99, parents or students over the age of 18 (“eligible students”) who do not want this information released must make a request in writing to the in whole or in part by a program of the U.S. Department of Education:

1. Political affiliations or beliefs of the student or student’s parent;
2. Mental or psychological problems of the student or student’s family;
3. Sex behavior or attitudes;
4. Illegal, anti-social, self-incriminating, or demeaning behavior;
5. Critical appraisals of others whom respondents have close family relationships;
6. Legally recognized privileged relationships, such as with lawyers, doctors, or ministers;
7. Religious practices, affiliations, or beliefs of the student or parents; or
8. Income, other than as required by law to determine program eligibility.

Receive notice and an opportunity to opt a student out of:

1. Any other protected information survey, regardless of funding;
2. Any non-emergency, invasive physical exam or screening required as a condition of attendance, administered by the school or its agent, and not necessary to protect the immediate health and safety of a student, except for hearing, vision, or scoliosis screenings, or any physical exam or screening permitted or required under State law; and
3. Activities involving collection, disclosure, or use of personal information obtained request shall be deemed consent to release directory information during the present school year.

As a parent of a student in the Newark Central School District, Federal law allows you to request certain information about the professional qualification of the classroom teachers who instruct your child. Please contact the Office of the Superintendent for more information.
